Terms of Service

These Terms are intended as a strong business-facing baseline for BounceOS under KM2 LLC. They reduce platform risk, but they should still be reviewed by your attorney before production use.

1. Agreement and Provider

These Terms of Service govern access to and use of BounceOS, a software platform operated by KM2 LLC. By accessing or using BounceOS, you agree to these Terms on behalf of yourself and, if applicable, the business entity you represent.

2. Service Scope

BounceOS provides hosted website, content, lead-management, scheduling, communication, and related operational software tools for rental operators. BounceOS is a software provider only and does not operate your rental business, supervise events, transport equipment, or interact with your customers except as directed by your configuration and content.

3. Account Eligibility and Authority

You must provide accurate registration information and keep account credentials secure. If you create an account for a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Customer Content and Operator Responsibility

You are solely responsible for all content, pricing, package descriptions, promotions, waiver language, customer communications, disclosures, tax treatment, and business practices presented through your BounceOS account or public site.

5. Waivers, Safety, and Event Operations

BounceOS does not draft legal waivers for you, review the sufficiency of your waivers, guarantee enforceability of any waiver, or provide safety, staffing, transportation, setup, teardown, supervision, inspection, or risk-management services.

6. Subscriptions, Billing, and Suspension

Paid features are governed by the pricing or order terms presented at signup or renewal. Fees are non-refundable except where required by law or expressly stated in a written plan. KM2 LLC may suspend or limit access for non-payment, abusive behavior, security incidents, unlawful use, or actions that threaten the platform or other customers.

7. Acceptable Use

You may not misuse BounceOS, interfere with the platform, attempt unauthorized access, upload malicious code, send unlawful or deceptive messages, infringe intellectual property rights, or use the service to facilitate fraud, spam, harassment, or illegal activity.

8. Third-Party Services

BounceOS may integrate with or rely on third-party services such as payment processors, hosting providers, SMS providers, map services, analytics tools, or waiver vendors. KM2 LLC is not responsible for outages, security events, data practices, content, pricing, or service terms of third-party providers.

9. Intellectual Property

KM2 LLC retains all rights in BounceOS, including the software, branding, interface, code, and platform materials, except for your content. Subject to these Terms and payment of applicable fees, you receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.

10. Disclaimers

BounceOS is provided on an as available and as is basis to the maximum extent permitted by law. KM2 LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, data accuracy, and results from use of the service.

11. Limitation of Liability

To the maximum extent permitted by law, KM2 LLC and BounceOS will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, bookings, customers, business opportunities, or business interruption.

12. Indemnification

You agree to defend, indemnify, and hold harmless KM2 LLC and its officers, members, employees, contractors, and agents from and against claims, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your business operations, your equipment or events, your use of BounceOS, your violation of law, or your breach of these Terms.

13. Termination

You may stop using BounceOS at any time. KM2 LLC may suspend or terminate access immediately for violations of these Terms, security risk, non-payment, or platform abuse.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or relating to BounceOS or these Terms shall be resolved exclusively in the state or federal courts located in Texas.

15. Changes to Terms

KM2 LLC may update these Terms from time to time by posting the revised version on the site. Your continued use after the effective date of updated Terms constitutes acceptance of the revised Terms.

Operational note

If BounceOS will process payments, marketing texts, or customer waivers at scale, add reviewed language for payments, SMS consent, data retention, and state-specific consumer rights before launch.
